[1] A lawsuit may not be brought more than three years after the infringement took place, unless the infringement was hidden from view, in which case the lawsuit must be brought within three years of when the infringement was discovered. However, each instance of copying or distribution is considered separately, so if the first infringement took place more than three years ago, a copyright owner may still file suit for any infringement that took place within the past three years.
